Ausz Terms and Conditions

Please read this Terms and Conditions.


By accepting the Terms and Conditions, the Client of Ausz Global app agrees to enter into an agreement with AUSZ GLOBAL Pty Ltd (ABN 22 638 227 684). In order to access and use the Ausz Global App and Website, the Client must agree to the Terms and Conditions which are set forth below.


General:


 
 

1.     All users of the Ausz Global website and/or Ausz Global apps (hereinafter referred to as “Ausz” (or Platforms)) designed by Ausz Global Pty Ltd (hereinafter referred to as “Ausz”) are bound by this Terms and Conditions. All Ausz Global clients (hereinafter referred to as “the Clients”) (whether a booking has been confirmed or not), by accessing or using Ausz Global Products, are deemed to have read and accepted all the following Terms and Conditions.



2.     Ausz's use of personal information submitted by the Clients is governed by its privacy policy. Ausz fully respects the Clients’ rights to privacy and utilizes the following practices regarding any information Ausz  is supplied with. To provide services to the Clients, Ausz  may require the Clients to provide certain information to Ausz, including, but not limited to, the Clients’ and/or the passengers’ names, addresses, phone numbers and credit card/payment details. By providing this information to Ausz, the Clients are deemed to agree to allow Ausz to utilize this information to complete all chauffeur services the Clients book.



3.     Whilst every effort has been made to ensure that the information contained in this Terms and Conditions is accurate, Ausz regrets it cannot accept liability for any errors or changes that may occur.



4.     If any provision under this Terms and Conditions is held to be illegal, invalid or unenforceable, either entirely or partially, under any legislation, such provision or part thereof shall to that extent be severed from the remainder of this Terms and Conditions and as such the legality, validity or enforceability of the remaining provisions shall not be influenced.



5.     Definitions:


In this Terms and Conditions, unless the context indicates otherwise, “the Drivers" means such persons who are duly authorized by Ausz Global Pty Ltd to provide chauffeuring services to the Clients via the Ausz Global platform; whereas "the Clients" means the persons, who make bookings for chauffeur services with Ausz, whether acting on their behalves or in their capacity as agents or in any other capacity for a third party or parties.



6.     Account Registration:


All users of Ausz, to access and/or use most functions at Ausz, must register for an Ausz account. The Clients must be aged 18 years or above, or have met the legal requirement of age majority in the Clients’ territorial jurisdiction to register an Ausz  personal or business account. Such account registration requires the Clients to submit requisite information such as the Clients’ names, addresses, phone numbers, and one valid payment method and its relevant details. The Clients are obliged to maintain accurate and updated requisite information at all times. Failure to do so would lead to the Client’s inability to access and use the Ausz services. The Clients are obliged to maintain the security of their account information and are responsible for all activities under their registered accounts.




7.     Fares & Routes:

Unless stated otherwise, all the Ausz fares are in Australian Dollars (AUD) and are inclusive of GST and Airport Parking  (if applicable), but toll fees not included.




8.     The Clients agree to pay Ausz the service rates plus all other fees opted for or utilized by the Clients as contemplated, including, but not limited to miscellaneous charges, additional chauffeurs, and any other miscellaneous charges and surcharges not specified hereof. In determining the service rates, and fees, the distance travelled by Ausz vehicles will be determined from the vehicle's meter, or if this is not possible for any reason, by Ausz’s customer support team in its sole and absolute discretion on any other fair and reasonable basis.




9.     The distance travelled will be determined by the routes taken by Ausz  drivers. The adopted routes and distances of the trips may be different from that displayed by GPS and/or other mapping software.




10. After-Hour Surcharge:

An additional “After-Hour Surcharge” of $15 will apply on top of the total fares for all pick-ups and drop-offs between 10 p.m. and 4 a.m.




11. Special Event Booking Surcharge:

Special event bookings including but are not limited to, Grand Prix, AFL Grand Final, Spring Carnival, Melbourne Cup Week, Christmas Day, New Year’s Eve, New Year’s Day, Australian Open, Avalon Air Show, and, weddings, tours, etc. will also incur an additional surcharge ranging from an extra 50% to 100% of the total fares.




12. Extended Times/ Additional Routing Instructions:

The Clients are responsible in the event of any charges incurred about the extra time required for bookings that have exceeded the confirmed booking schedules. Any extra stops requested by the Clients that have not been confirmed and settled at the time of the bookings will incur additional charges.




13. Minor Passengers:

Any passenger who is aged 11 years or under must be accompanied by at least one adult passenger to use the Ausz chauffeur service. Car-seat requirements must also be strictly complied with according to applicable local legislation.




14. Pets:

No pets are permitted inside Ausz vehicles.




15. Insurance:

All trips with Ausz vehicles are covered by public liability and commercial insurance. Although every effort will be made to ensure the safekeeping of personal properties, Ausz does not accept liability for the loss of personal items. The Clients are advised to check if they have sufficient coverage for all the personal properties that they bring onto Ausz vehicles.
 
 



16. Liabilities and Obligations:

Whilst Ausz takes every reasonable safeguard to achieve satisfactory and punctual services by its drivers, Ausz is not liable for delays or booking cancellations caused by force majeures, unforeseeable and/or unpreventable adverse traffic or weather conditions, nor vehicle breakdowns or other accidents, etc. Ausz is not liable for any damage or loss elicited by the deed, negligence or error of any driver or other third party. If liability is unable to be excluded, liability is limited to the value of the Clients’ full fare.




17. Ausz does not assume responsibility for circumstances beyond its control. Should a vehicle breakdown or mishap be rendering the reserved vehicle out of commission, Ausz reserves the right to substitute a vehicle/vehicle. Ausz will make every effort to supply an alternate vehicle and advise the Clients in advance of the booked pick-up date and time. In case Ausz is unable to provide an alternate vehicle(s), a full or partial refund may be paid to the Clients. There is no guarantee for Ausz to supply identical vehicles.




18. Ausz has no liability for loss, property damage, personal injury, or death incurred during the use of Ausz chauffeur services unless:

a.     such loss, property damage, personal injury or death is/are caused solely by Ausz's negligence; and 

b.     such liability cannot be excluded under law (in which case it is limited to the maximum extent permitted under the law).




19. All Ausz vehicles may only be driven by the chauffeur Drivers. The Drivers and all passengers including the Clients must wear safety seatbelts when the vehicles are set in motion.




20. All Ausz vehicles must not be used for any illegal and/or unlawful activities, or any other form of high-risk activities including but not limited to smoking. Corrosive, noxious, hazardous, flammable, explosive, radioactive or other dangerous goods and/or materials, or any goods and/or materials which in Ausz’s opinion are likely to cause damage to the vehicles, must not be transported.




21. Ausz drivers have the right to terminate rides without refund in the event of blatant indiscretion on the part of the Clients. It is not permitted to stand through the sunroof in any of Ausz's vehicles. Smoking is strictly not permitted in any of Ausz’s vehicles. If the Clients or passengers travelling with the Clients cause damages to Ausz vehicles, the Clients are liable to compensate for such damages. A fixed sanitation fee of $400.00 may be applicable on all Ausz vehicles.




22. Ausz is not responsible for any items left in Ausz vehicles. Vehicles cannot be loaded beyond seating capacity. Luggage, prams and other accessories are restricted to boot capacity only – those which do not fit in the boot of a sedan will not be placed within the vehicle under any circumstances. In such instances, the Clients are liable to organize alternative means/of transport to transfer their luggage.




23. Consumption of water in all Ausz vehicles is permitted. Nevertheless, Ausz requires all other beverages and food to be approved before the bookings, under which circumstances the Clients assume full responsibility for any damage and cleaning fee resulting from such food and/or beverage consumption in Ausz vehicles.




24. Regarding airport drop-offs, it is the responsibility of the Clients to allow enough time to arrive at the airport and check in before the airline check-in counters close. Local traffic conditions and unforeseen circumstances can affect travel time, and the Clients are deemed to acknowledge and accept those risks when booking with Ausz.




25. If a client has made a booking with Ausz and is unable to locate the driver and chooses not to contact Ausz, the Client will be liable for the full transfer cost up to AU$120.00 as a passenger no-show.




26. The Clients are deemed to accept full liability for any caused damage to Ausz  vehicles made before, during or after the booked trips, be it made by the Clients or anyone travelling together with the Clients.




27. Modifications:

If the Clients want to make any change to any booking after the bookings have been confirmed, such changes can only be accepted and made subject to drivers’ and vehicles’ availability, and these changes are not confirmed until the relevant drivers have acknowledged and accepted the proposed changes. Ausz Global reserves the right to charge a fee for any modification made to confirmed bookings.




28. All bookings and fares, once confirmed, will remain unchanged unless the Clients change the details of their bookings’ pick-up and/or drop-off locations; or extend the booking time/s. The Clients are advised to contact their Ausz Drivers via the Ausz apps, or the Ausz client support team if they wish to modify the pick-up and/or drop-off times, routes or dates and times as soon as they can. Ausz ensures that every effort will be made to accommodate the modification requests, however, Ausz  cannot guarantee to be able to do so. If the relevant bookings must be cancelled due to the proposed modifications to the bookings, the Ausz client support team and/or the respective Drivers would use their best endeavours in a reasonable time to re-organize the bookings for the Clients. Likewise, Ausz  cannot guarantee to be able to do so. In such circumstances, subject to Ausz’s cancellation policy, a full or partial refund may be made to the Clients.




29. Extra Waiting and No-Shows:

To ensure the dependability of Ausz chauffeur service, it is, therefore, necessary to reserve and dispatch specific vehicles and drivers for the Clients. Ausz offered 30 minutes of Free waiting for Airport picks up after the preferred pick-up time, and 10 minutes of Free waiting for other point-to-point bookings. If the Clients do not appear nor contact the Ausz customer support team and/or their Ausz drivers at the booked dates and times and the designated pick-up points, the Drivers will notify the Clients whether they can wait for up to an additional 30 minutes for an incurred charge calculated $1 per minute or that they can no longer wait. In such instances, Ausz reserves the right to make full charge for the booked trips and no refund would be made to the Clients in such “No-show” situations.




30.  The booked pick-up times should be strictly adhered to, without exception. Last-minute notifications of changes in pick-up times would only be accepted with the relevant Drivers’ confirmation. The Drivers will wait for a maximum of 10 minutes from the nominated pick-up time for free. After which the Drivers will notify the Clients whether they can wait for up to an additional 30 minutes for an incurred charge calculated based on the hourly rate, or that they can no longer wait. In such instances, Ausz reserves the right to make full charge for the booked trips and no refund would be made to the Clients.




31. Cancellations & Refunds:

The Clients have the right to cancel their reserved bookings subject to Ausz’s cancellation policy. All cancellations of bookings over 3 hours before the booked pick-up times would incur no charge, subject to an administrative surcharge (if applicable). For cancellations of bookings made between 3 hours and 90 minutes, half of the paid fares up to AU$60.00 would be charged to the Clients. For cancellations of bookings made within 90 minutes before the booked pick-up times, fully paid fares up to AU$120.00 would be charged, and no refund would be made to the Clients. Ausz  would however take into consideration reasons beyond the Clients’ control when deciding about the full or partial refund.






32. Amendments to Terms and Conditions:

Ausz may amend this Terms and Conditions from time to time without notice. Amendments will be effective upon Ausz’s posting of such updated Terms and Conditions on its website and/or apps. The Clients are advised to check this Terms and Conditions at the time of booking. The Clients’ continued access or use of Ausz’s chauffeur services constitutes their consent to be bound by the amended and updated Terms and Conditions.
